JK ROWLING VANT SAK MOT ENGELSKE PAPARAZZIER 

Da JK Rowling og hennes mann var på trilletur med sin da 20 mnd gamle sønn ble de fotografert av en paparazzi som solgte bildene til The Sunday Express. Rowling saksøkte avisen for krenkelse av den private sfære.  

Court of Appeal i England uttalte at loven måtte beskytte barn på en slik måte at barnet har ”a reasonable expectation that he would not be targeted in order to obtain photographs in a public place for publication, where the taking of such photographs would be objected to on his behalf ”. According to the House of Lords' Minutes of Proceedings this week, the highest appellate court in the United Kingdom has refused Big Pictures (UK) Limited leave to appeal against the Court of Appeal's decision in its controversial dispute with little David Murray, better known as the son of Harry Potter author J K Rowling. Earlier this year the Court of Appeal (as noted by the IPKat here in "Now you can buy milk without being shot", allowing David's appeal) refused to strike out an action brought on behalf of the child, considering that it was at least arguable that David had a reasonable expectation of privacy and that the balance between Articles 8 and 10 of the European Convention on Human Rights should be struck in his favour. The trial on the merits of his claim has yet to take place.
